STATE OF OKLAHOMA TO: All persons having or asserting any interest, claim or lien in the following described real property and the Defendants, Susannah Gutierrez, formerly Susannah Miller, and Manuel Gutierrez, wife and husband; and Occupants of the Premises of 1802 N. 5th Street, Duncan, Oklahoma (now 3344 N. 5th Street, Duncan, Oklahoma):
Notice is given that on the 11th day of March, 2026, at 10 o'clock A.m., at the front door of the Stephens County Sheriff's Office located at 245 S. 10th Street, in Duncan, Oklahoma, the undersigned Sheriff will offer for sale and sell to the highest bidder all that certain real estate in Stephens County, Oklahoma, to-wit:
SURFACE AND SURFACE RIGHTS ONLY:
A tract of land described as beginning 405 feet North of the SW/corner of the SW/4 NW/4 SW/4 of Section 28, Township 1 North, Range 7 West, I.M., Stephens County, Oklahoma; thence North 135 feet to a point; thence East 660 feet to a point; thence South 135 feet to a point; thence West 660 feet to the point of beginning,
(Having a commonly known street address of: 3344 N. 5th Street, Duncan, Oklahoma; formerly known as 1802 N. 5th Street, Duncan, Oklahoma)
Said lands and tenements have been appraised according to law at $98,000.
Sale of the above described real property is subject to any unpaid ad valorem taxes and nuisance liens.
Sale will be made pursuant to an Order of Sale in Foreclosure issued upon judgment entered on the 17th day of December, 2025, in the District Court of Stephens County, Oklahoma, in Cause No. CJ-2025-140, wherein First Bank & Trust Co., Duncan, Oklahoma, was Plaintiff, and Susannah Gutierrez, formerly Susannah Miller, and Manuel Gutierrez, wife and husband; and Occupants of the Premises of 1802 N. 5th Street, Duncan, Oklahoma, were Defendants, to satisfy said judgment in the sum of $78,784.62, as of the 8th day of September, 2025, with interest thereon thereafter at the rate of $15.03 per diem until paid, all as provided for in said Promissory Note and Mortgage, and for court costs in the amount of $292.14, private process server fees in the amount of $50.00, a reasonable attorney fee in the amount of $6,000.00, plus force place insurance expense expended by Plaintiff, abstracting expense in the amount of $925.00, and for future advances for the maintenance and preservation of said real property, and all costs of this action accrued and accruing.
